Welcome to EARNGN™ ("Platform"). By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"), forming a legally binding agreement between you and EARNGN™. If you do not agree with these Terms, please do not use the Platform.
1. Account Registration
To access the full features of the EARNGN™ platform, including the Truth Gate analysis, you must create an account. You agree to provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
2. The "Truth Gate" AI & Truth Scores
EARNGN™ provides a proprietary AI-powered analysis known as the Truth Score.
▪️ Analytical Tool: The Truth Score is a decision-support metric based on AI consistency checks. It is intended for informational purposes only.
▪️ No Guarantee of Accuracy: While we strive for precision, AI-generated scores are estimates. EARNGN™ does not warrant that a Truth Score is a 100% accurate reflection of a candidate's background.
▪️ Hiring Decisions: The final responsibility for vetting a candidate and making a hiring decision rests solely with the Employer.
3. Job Listings & External Postings
▪️Direct Listings: Employers posting directly to EARNGN™ agree that all listings are accurate, lawful, and non-discriminatory.
▪️ External/Aggregated Jobs: Some listings on the Platform are aggregated from third-party sites.
▪️ Redirection Warning: When applying for external jobs, you will be redirected away from Earngn.com. We have no control over, and assume no liability for, the content, privacy policies, or data practices of these third-party platforms.
4. Job Applications & Candidate Truthfulness
As a Candidate, you agree to provide truthful and non-fraudulent information.
▪️AI Consistency: Our Platform uses AI to detect discrepancies. Intentional submission of false data may result in a "Low Truth Score" or permanent suspension from the Platform.
▪️No Guarantee of Employment: Use of the Platform or achieving a high Truth Score does not guarantee an interview or a job offer.
5. User Content & AI Processing
You retain ownership of your resumes, job descriptions, and profiles ("User Content"). By uploading content to EARNGN™, you grant us a worldwide, royalty-free license to use, reproduce, and display this content to operate the Platform.
▪️ Private AI Processing: We process User Content through secure, private AI instances (such as Google Gemini). Your personal data is never used to train public AI models.
6. Prohibited Activities
You agree not to:
▪️ Use automated bots, scrapers, or "spiders" to harvest candidate or job data.
▪️Attempt to "game" or manipulate the Truth Gate algorithm through fraudulent inputs.
▪️ Post misleading, harassing, or unlawful content.
▪️ Use the Platform to discriminate against users based on protected characteristics.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARNGN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS OR EMPLOYMENT OPPORTUNITIES) ARISING FROM YOUR USE OF THE PLATFORM OR RELIANCE ON THE TRUTH SCORE. Our total liability shall not exceed the amount you paid to EARNGN™ in the six months preceding the claim.
8. Indemnification
You agree to indemnify and hold EARNGN™, its officers, and employees harmless from any claims or losses arising out of your violation of these Terms, your User Content, or your misuse of the Truth Gate system.
9. Modifications to the Platform
EARNGN™ reserves the right to modify, suspend, or discontinue any feature (including the Truth Score logic) at any time without prior notice.
10. Governing Law
These Terms shall be governed by the laws of the United States of America/Pennsylvania, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts in York/Pennsylvania.
